Terms and conditions

These terms apply to everyone who uses Puppymakelaar: visitors, buyers and breeders. By creating an account or placing a listing, you accept these terms.

Puppymakelaar is an online advertising platform on which breeders can offer puppies and where anyone interested can find information about breeds. Puppymakelaar does not sell any animals itself, is not a party to any sale and does not intervene in the arrangements between buyer and seller. Any contract concerning an animal is concluded directly between you and the advertiser.

3. Your account

• You must provide accurate and complete information and keep it up to date. You are responsible for everything that happens through your account; keep your password secret.
• Breeders in Belgium must hold a valid approval number (HK number). We check that number against the public register of approved breeders. Breeders in the Netherlands provide their UBN and upload proof from Mijn RVO, which we check before they can publish.

4. Rules for listings

As the advertiser, you yourself are responsible for your listing and for complying with the law, in particular the rules on animal welfare and on the trade in and advertising of dogs. Your listing:

• is truthful and not misleading (breed, age, health, vaccinations, pedigree, price);
• states the information that the law requires in an advertisement for dogs, such as your approval number (HK number) or your UBN;
• contains only photos and texts to which you hold the rights;
• concerns dogs that you may lawfully offer. You may place a listing for a young litter; if you do, state the date from which the puppies will be available. As a breeder, you remain responsible for not handing over a puppy until it is old enough.

You give Puppymakelaar permission to display, format and translate the content of your listing for as long as the listing is online.

5. Reporting, suspension and blocking

• Anyone can report a listing that appears to breach the rules or the law.
• We may refuse a listing that breaches these terms or the law, revert it to draft, suspend it or remove it, and we may block an account in the event of serious or repeated breaches or of abuse.
• In the event of a suspension or block, we will tell you the reason. You can appeal against a suspension through the platform; we will review your appeal and let you know our decision.
• If a paid listing is suspended or removed because it breaches the rules, you are not entitled to a refund.

6. Prices and payment

• The prices for placing, renewing and promoting listings are set out on the Pricing page. You pay the price shown at the time of your order, including VAT.
• You pay online through our payment provider (Stripe), using the payment methods offered there. A listing or promotion becomes active as soon as the payment has been confirmed.
• You are responsible for what you order and publish. A mistake made when placing a listing, such as the wrong breed, the wrong duration or promotion, or an error in the text or photos, does not entitle you to a refund or a credit note. You can, however, edit the text, photos and price free of charge for as long as your listing is online. The breed cannot be changed once the listing has been published.
• A refund is only possible if the error lies with Puppymakelaar, for example where a paid listing did not go online because of a technical problem, and without prejudice to your right of withdrawal as a consumer (see Article 7).
• With a VAT number, you will receive your invoice electronically. Without a VAT number, you will receive a payment confirmation by email.
• A listing stays online for the duration you choose. It then expires and you can renew it. Promotions and boosts run for the period chosen.

7. Right of withdrawal

Listings, renewals and promotions on Puppymakelaar are placed by breeders for the purposes of their professional activity. The statutory 14-day right of withdrawal applies only to consumers and therefore does not apply here.

8. Liability

• Puppymakelaar does not check listings in advance and gives no guarantee as to their accuracy, nor as to the health, origin or characteristics of any animal, or the course of any sale. Always make your own arrangements and carry out your own checks with care.
• We do our best to keep the site running properly and securely, but cannot guarantee that it will always be available without interruption or errors.
• Our liability is limited to the amount you paid us for the service concerned, except in the case of wilful misconduct, fraud or gross negligence, and to the extent permitted by law. Your statutory rights as a consumer remain unaffected.
• The information on the site about breeds and health is general in nature and is no substitute for advice from a vet.

9. Intellectual property

The site, its design, the logos and the editorial content of Puppymakelaar are protected. You may not reproduce them without permission. The content of your own listings remains yours.

By placing a listing, you declare that you hold the rights to the photos and texts you use, and you grant Puppymakelaar permission, free of charge, to display, resize and distribute them on the site and in our messages for as long as this is necessary for the service. Public pages may be read and stored by search engines and AI services. If anyone asserts rights in content that you posted, you are responsible for this and you indemnify Puppymakelaar against that claim.

11. Changes

We may amend these terms. The version in force at the time of your order continues to apply to that order. We will notify you in advance of any significant changes.

12. Governing law and disputes

These terms are governed by Belgian law. If a problem arises, please contact us first; we are happy to work with you to find a solution. If that is not possible, the Belgian courts have jurisdiction. If you are a consumer, you retain the protection afforded to you by the law of your place of residence, and you can also contact the Belgian Consumer Mediation Service (consumentenombudsdienst.be).
